1. Definitions

• myco: Refers to our platform, including the Site and App.
• User-Generated Content (UGC): Refers to content uploaded by users, including videos, images, and thumbnails.
• Video-on-Demand (VOD): Pre-recorded video content available for streaming.
• Subscription Video-on-Demand (SVOD): Video content accessible through a paid subscription.
• Transactional Video-on-Demand (TVOD): Video content purchased or rented for one-time viewing.
• Live Content: Real-time streamed videos.
• Rewards: Points or tokens earned by users for watch time or other qualifying activities.
• Services: All features and functionalities provided on the Site and App.

2. Eligibility

• You must be at least 18 years of age or the legal age in your jurisdiction to create an account and use our Services.
• If you are under 18, you may use myco with parental consent and under their supervision.

3. Account Registration

• You must create an account to upload content, interact with other users, or access certain features (e.g., SVOD, TVOD).
• By registering, you agree to:
• Provide accurate and complete information.
• Keep your password secure and confidential.
• Notify us immediately of unauthorized account use.

4. User-Generated Content (UGC)

4.1 Ownership and Licensing

• You retain ownership of the content you upload to myco.
• By uploading UGC, you grant myco a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, display, and distribute your content for the purposes of providing and promoting the Services.
• You represent and warrant that:
• You own or have the necessary rights, licenses, consents, and permissions to upload the content.
• Your content does not infringe the copyright, trademark, privacy, or other rights of any third party.

4.2 Prohibited Content

You agree not to upload content that:

• Contains explicit nudity, sexual, or obscene material.
• Promotes violence, hate speech, or discrimination.
• Infringes on copyright, trademarks, or other intellectual property rights.
• Violates any applicable laws or regulations.

4.3 Copyright Compliance

• Copyright Responsibility: You are solely responsible for ensuring that all content you upload complies with copyright laws.
• Music and Third-Party Assets: If your content includes music, images, videos, or other assets created by third parties, you must have the appropriate licenses or permissions to use them.
• Copyright Infringement Reporting:
• If you believe your copyrighted work has been used on myco without permission, you may submit a copyright infringement notice to myco via email at support@myco.io
• Your notice must include:
• Identification of the copyrighted work you claim has been infringed
• A description of where the infringing material is located on the platform.
• Your contact information (name, address, phone number, email).
• A statement that you believe in good faith that the use of the material is unauthorized.
• A declaration that the information provided is accurate, and under penalty of perjury, that you are the owner or authorized to act on behalf of the owner.
• Response to Notices: Upon receiving a valid infringement notice, we will remove the content in question and notify the user who uploaded it.

4.4 Repeat Infringer Policy

• myco has a zero-tolerance policy for repeat infringers. Accounts found to repeatedly upload infringing content will be permanently terminated.

4.5 Moderation and Reporting

• User Responsibility: Users can report inappropriate or infringing content using in-app reporting tools.
• Platform Action: Reported content will be reviewed promptly, and appropriate actions, such as removal or account suspension, may be taken at myco's sole discretion.

4.6 Liability for UGC

• Indemnification: You agree to indemnify and hold myco harmless from any claims, damages, or liabilities arising from the content you upload, including but not limited to copyright infringement, defamation, or violation of any third-party rights.

5. Content Monetization

• Revenue Sharing: If users monetize content through ads, tips, or subscriptions, myco retains a commission from the revenue generated.
• Tax Obligations: Users are responsible for reporting and paying any applicable taxes on earnings.
• Content Licensing: Monetized content grants myco the right to distribute, promote, and feature it on the platform.

6. Advertising and Sponsorships

• Ads may appear before, during, or after content. myco is not responsible for the content of third-party ads.
• Sponsored content must comply with local advertising laws, including disclosure requirements.

7. Rewards System

7.1 Earning Rewards

• Users earn rewards for watch time, engagement, and other platform activities.

7.2 Redemption and Expiration

• Rewards points expire 12 months after issuance unless stated otherwise.
• Redemption options may vary based on user location.

8. Payments and Subscriptions

• Payments for subscriptions, rentals, or purchases must be made through approved payment methods.
• Prices are subject to change. Users will be notified of price changes before the next billing cycle.

9. Accessibility

• myco is committed to making its platform accessible to all users, including those with disabilities. Accessibility issues can be reported to support@myco.io

10. Data Privacy Compliance

• Your use of myco is governed by our Privacy Policy.
• We comply with applicable data privacy laws, including GDPR and CCPA.

11. Geographic Restrictions

• Certain features or content may be unavailable in specific regions due to licensing or legal constraints.

12. Dispute Resolution

• Disputes must be resolved through arbitration. Users waive their right to class actions

13. Security Incidents

• In case of a data breach, myco will notify affected users promptly.

14. Termination

• Accounts violating these Terms may be terminated. Terminated accounts forfeit rewards and monetization balances.

15. Liability and Disclaimer

myco provides Services "as is" and is not responsible for:

• User-generated content.
• Losses due to account termination.

16. Changes to These Terms

We may update these Terms and will notify users of significant changes.
